dc.description.abstractEnglish: This article briefly discusses some legal determinants that influence education in Australia and South Africa, respectively. It is evident that schools whose hierarchy members fail to take the necessary steps to ensure a non-threatening environment may be held liable if negligence can be proven. The focus is therefore on principles and procedures regarding the management of learner discipline, with specific reference to bullying. The article concludes with an analysis of qualitative data from a research project into learner discipline in Australia and South Africa, and a comparison of the respective risk management strategies.en_ZA
dc.description.abstractAfrikaans: Hierdie artikel ontleed kortliks enkele regsdeterminante wat ’n invloed het op die onderwys in Australië en Suid-Afrika. Dit is duidelik dat skole wat in gebreke bly om ’n veilige omgewing te verseker, aanspreeklik gehou kan word indien nalatigheid bewys kan word. Die fokus is dus beginsels en prosedures ten opsigte van die bestuur van leerderwangedrag, met spesifieke verwysing na afknouery. Die artikel sluit af met kwalitatiewe inligting uit ’n navorsingsprojek in Australië en Suid-Afrika rakende leerderdissipline, en ’n vergelyking van die onderskeie risikobestuursbenaderings.af
