    Abstract
    English: In order to develop the South African common law and understand how legal processes must transpire in contemporary South Africa, a historic-social-contextual analysis is proposed. Such a critical analysis not only assists courts in understanding the development of this country’s common law as well as the external and internal influences affecting it, but also enables them to build a historic bridge between the past of a deeply divided society and a future founded on constitutional values.
     
    Afrikaans: Ten einde die Suid-Afrikaanse gemenereg te ontwikkel en te verstaan hoe regsprosesse binne ’n hedendaagse Suid-Afrika moet verloop, word ’n geskiedkundig- sosiaal-kontekstuele analise voorgestel. So ’n kritiese analise help howe nie alleenlik om die ontwikkeling van dié land se gemenereg sowel as die eksterne en interne invloede wat daarop inwerk te begryp nie, maar bemagtig hul voorts om ’n geskiedkundige brug te bou tussen die verlede wat gekenmerk was deur ’n diep verdeelde samelewing en die toekoms wat op grondwetlike waardes gegrond is.
