    Abstract
    English: The life insurance contract exists between the insurer and insured. A beneficiary may however be named in the policy to receive the proceeds at the death of the insured. This situation is assumed in the South African right to be a stipulatio alteri. Acceptance is a unique South African requirement set for the beneficiary in applying the stipulatio alteri. It does not entirely relate to the intention of a true agreement on behalf of a third. The beneficiary's rights are very limited. Before the death of the insured the named beneficiary has no right. At this stage it is also impossible for him/her to accept the stipulation to his/her advantage. At the death of the insured a contingent right developed for the beneficiary and must be protected until the beneficiary has indicated his/her intention to accept or refuse the benefit. Once the beneficiary accepts the benefit, he acquires a vested right to the proceeds of the policy.
     
    Afrikaans: Die lewensversekeringskontrak bestaan tussen die versekeraar en versekerde. Daar mag egter ʼn begunstigde benoem word om die polis voordele te verkry by die versekerde se dood. Hierdie situasie word aangeneem in die Suid-Afrikaanse reg om ʼn stipulatio alteri te wees. Aanvaarding is ʼn unieke Suid-Afrikaanse vereiste wat gestel word vir die begunstigde in die toepassing van die stipulatio alteri. Dit stem nie ooreen met die bedoeling van ʼn ware ooreenkoms ten behoewe van ʼn derde nie. Die begunstigde se regte is baie beperk. Voor die dood van die versekerde bestaan daar vir die benoemde begunstigde geen regte nie. Dit is ook nie in hierdie stadium vir hom/haar moontlik om die stipulasie tot sy/haar voordeel te aanvaar nie. By die dood van die versekerde ontwikkel daar vir die begunstigde ʼn voorwaardelike reg wat beskerm moet word tot die begunstigde die voordeel aanvaar of weier. Sodra die begunstigde die voordeel aanvaar het, verkry hy/sy ʼn gevestigde reg op die opbrengs van die polis.
