    Regsverteenwoordiging tydens dissiplinêre optredes en arbitrasies - 'n kort oorsig oor die huidige regsposisie

    Abstract
    English: With the recent amendments to the Labour Relations Act 66 of 1995 the question of legal representation was raised again. This article deals with the current legal position and explains the advantages and disadvantages of legal representation during disciplinary action and arbitrations. In conclusion legal representation should always be an option for any party during any disciplinary action. The presiding officer should, however, have a discretion not to allow legal representation if circumstances allow it. Legal representation will definitely enhance and promote just and fair dispute resolution and disciplinary action. Legal practitioners can play a meaningful role in maintaining good labour relations and ensuring fairness between the employer and employee. There is little justification for summarily excluding legal representation.
     
    Afrikaans: Met die onlangse wysigings in die Wet op Arbeidsverhoudinge 66 van 1995 het die vraag na regsverteenwoordiging weer sterk na vore getree. In die artikel word die huidige regsposisie uiteengesit. Die voordele en nadele van regsverteenwoordiging tydens dissiplinêre optrede en arbitrasies word bespreek en opgeweeg. Gevolglik behoort regsverteenwoordiging altyd 'n opsie in enige dissiplinêre verrigting te wees. Regsverteenwoordiging sal beslis bevorderlik wees vir billike en regverdige geskilbeslegting en dissiplinêre optrede. Regspraktisyns kan 'n sinvolle rol speel om goeie arbeidsverhoudinge in die werksplek te handhaaf en billikheid teenoor beide die werkgewer en werknemer te laat geskied. Daar is te min gronde om regsverteenwoordiging summier uit te sluit. Daar behoort 'n diskresie aan elke voorsittende beampte in dissiplinêre ondersoeke en eksterne kommissarisse te wees om regsverteenwoordiging uit te sluit indien die omstandighede dit vereis en dat elke party outomaties die reg het om deur 'n regspraktisyn verteenwoordig te word.
